laline rEWARDS program - terms and conditions
The Laline rewards program (the “Program”) is a rewards program offered by Laline Candles and Soaps Ltd. (“Laline”, “our”, “we” and “us”) under these terms and conditions (the “Terms and Conditions”) to customers of Laline retail locations in Canada (“Participating Stores”) and on-online at [www.laline.ca].
The Program allows individuals who have completed the membership enrolment steps in accordance with these Terms and Conditions (the “Members”) to: (i) collect and redeem Loyalty Points when making purchases in-store (ii) qualify from exclusive Laline Promotions, and (iii) receive an annual Birthday Discount.
Membership is free and no initial purchase is required in order to become a Member. Each Member must hold a valid Laline rewards card (the “Card”) and open a Laline rewardsaccount (“Account”).
To become a Member, simply ask an employee at a Participating Store to sign you up. To become a valid Member, you must complete the enrolment process by providing complete and accurate information and indicating your acceptance of these Terms and Conditions.
Only one Account is permitted per individual. Laline reserves the right to refuse the opening of an Account to any individual who does not follow the prescribed enrolment procedures.
Members must be (i) a Canadian resident in Ontario, Quebec, British Columbia or Alberta, and (ii) the age of majority in the jurisdiction of your residence.
If you sign up at a Participating Store, you will be given a card with a unique member number (the “Card”).
The Card is the property of Laline and may be revoked at any time by Laline if Laline determines that a Member has abused any of the Program’s privileges, fails to comply with any of these Terms and Conditions or makes any misrepresentation to Laline. The Card is not a credit card.
Members cannot share their Account information with anyone else. Membership benefits apply only to the individual Account holder. Account information, including, but not limited to, the Account password should be protected and kept secure.
Program membership is granted in Laline’s sole discretion, and may be withdrawn or suspended in Laline’s sole discretion with or without notice and without liability to Laline.
Loyalty points will be awarded at the rate of 10% of each dollar spent on each separate purchase of eligible products at Participating Stores (“Loyalty Points”). Loyalty Points will be calculated with reference to the purchase price of eligible products, less applicable discounts and taxes as shown on each purchase receipt. You are required to present your Card prior to payment in order to receive Loyalty Points. Loyalty Points will not be granted on previously-completed purchases where a valid Card was not presented prior to payment.
From time to time, Members may be awarded discounts, rebates or other promotions to be used in-store and/or online (“Laline Promotions”). You may use your Card to take advantage of these promotions, without having to load such offers onto your Account prior to completing the purchase.
During your birthday month, all Members will be eligible for a 30% discount on any single purchase in-store only (“Birthday Discount”). Discount applies to purchases that do not exceed the amount of $200.
The Loyalty Points, Laline Promotions and Birthday Discount constitute, collectively, the “Laline Rewards.”
To “redeem” means to use your Laline Rewards to pay, or partially pay, for eligible purchases by using your Card at the point of sale in Participating Stores that offer redemption, following the instructions provided by the cashier, the point-of-sale terminal or other payment processing device.
One Loyalty Point is worth one dollar. Each customer has the right to redeem his loyalty points when he reaches a minimum of 30 points. To "redeem", means to use Laline Rewards to pay or partially pay for eligible purchase by using membership card at the point of sale.
Customer must redeem a minimum of 10 loyalty points at a time, which are worth 10$ in rewards.
Birthday Discount could redeemed during the birthday month only, while presenting a valid ID matching your account information. Birthday Discount could only be redeemed at stores.
Only one Laline Reward can be redeemed at any time. Accordingly, Loyalty Points and/or Laline Promotions and/or the Birthday Discount cannot be redeemed at the same time.
Laline Rewards cannot be earned or redeemed when purchasing a Donation product.
Loyalty Points are not earned on the portion of a transaction that is being paid for by Loyalty Points and/or Laline Promotions. As for Birthday Discount they could only be earned but not redeemed.
Loyalty Points or Laline Promotions you earn upon making a purchase cannot be redeemed for that purchase and can only be redeemed for a subsequent eligible purchase.
Laline Rewardsare not transferable or assignable.
Loyalty Points do not expire. However, your Account is deemed to be inactive if Loyalty Points are not earned in connection with such Account for 12 consecutive months. Once an Account is deemed to be inactive, all Laline Rewards in such Account may, in Laline’s sole discretion, be deemed to have been forfeited by such Member. Prior to the date your Account becomes inactive, we will provide you with a 60 days’ written notice that if your Account should remain inactive at that date then all Laline Rewards in such Account will be forfeit.
In any one transaction, Loyalty Points may only be earned on a single Card, and may only be credited to a single Account.
If you return a purchase, your Account balance may be reduced by the number of Loyalty Points earned for that purchase at our sole discretion. If a refund or correction is applied to your Account, your Account balance will be adjusted up or down by the number of Loyalty Points related to the refund or correction, as applicable, and your Account balance may become negative.
Upon the return or exchange of purchases earned through the redemption of Laline Rewards at Participating Stores, all redeemed Laline Rewards will be forfeited and the Member will receive the value of the returned product in the form of a store credit.
Our records of the number of Laline Rewards earned, redeemed or deducted are deemed accurate. If you have a concern regarding your Account balance (including Loyalty Points balances), you must contact us and provide relevant evidence within 45 days from the relevant transaction date to report any discrepancy. If we do not hear from you within 45 days, it means you agree with us as to your Account balance of any Laline Rewards.
The number of Loyalty Points displayed on your receipt at a Participating Store, or on any website, email, mobile app or by any other method, may not reflect your current Loyalty Points balance according to our records. To the extent permitted by law, we accept no liability for any errors in the Loyalty Points balance displayed on any website, email, mobile app or other method. If any Laline Points are awarded to your Account in error, we reserve the right to deduct the number of Laline Points awarded in error at any time and without notice to you. We are not obligated to honour a request to redeem Laline Points added to an Account in error. Laline Rewards will not be awarded if in our reasonable opinion the products purchased will be used for resale or commercial use and any Laline Rewards awarded on such purchases will be forfeited.
If your Card is lost or stolen, contact us to turn off redemption capabilities for that Card. You are responsible for all redemptions on your Account, including any redemptions made on your Account before you turn off redemption capabilities on a Card that was lost or stolen, and all redemptions made on your Account as a result of unauthorized access to your Account, such as due to a failure to safeguard your password.
Laline Rewards have no cash value and are not exchangeable for cash and cannot be sold, traded, bartered, rented or otherwise disposed of. Laline Rewards are void if sold for cash or any other consideration.
You agree to ensure that any personal information and other information you provide us in connection with the Program is up-to-date and accurate, and to notify us of any change to such information by asking an employee at a Participating Store to update the information in-store, by visiting [www.laline.ca] or by contacting us at +14378892688
All aspects of the Program are offered by Laline in its sole discretion. The earning, accumulation or redemption of Laline Rewards does not entitle you to any vested rights, and Laline does not guarantee in any way the continued availability of any Laline Rewards, or any other aspect of the Program. Except as otherwise specified in these Terms and Conditions, Laline may restrict, suspend or otherwise change, at any time, but upon no less than 60 days’ prior written notice to you, any eligibility rules, Loyalty Points earning and accumulation rules, Loyalty Points management rules, Loyalty Points redemption or Laline Rewards conditions and limitations, taxation rules or any other aspect of the Program, including any provision of these Terms and Conditions. The written notice will contain the new or amended term or provision, the former term or provision (if applicable), the date that the change will come into force and your rights which are described as follows. If you do not accept such change, your remedy is to terminate your participation in the Program in accordance with the Program Suspension and Termination section below.
The Program will continue until (i) Laline terminates the Program, (ii) Laline terminates your participation in the Program, or (ii) you withdraw from the Program.
Laline, in its sole discretion, may terminate the Program or your participation in the Program, at any time upon 60 days’ prior written notice to you. Laline reserves the right to terminate the Program without notice if events beyond Laline’s control affect its ability to operate the Program. Laline further reserves the right to terminate your participation in the Program without notice if you become no longer eligible, or if we reasonably suspect that you are using any aspects of the Program in a fraudulent, abusive or inappropriate way, or are not complying with these Terms and Conditions. You may, at any time, withdraw from the Program by notifying us online at [www.laline.ca], by phone at +14378892688 or by registered mail at email@example.com
You will have 12 months from the date Laline terminates the Program, Laline terminates your participation in the Program, or you withdraw from the Program (as applicable) to redeem any accumulated Laline Rewards. After 12 months your Laline Rewards will become null and void and will no longer be redeemable.
Except with respect to residents of Quebec, the Program, your Account, the Laline Rewards, and all other Program materials (collectively, the “Program Materials”), are provided on an “as is” basis. Except with respect to residents of Quebec, Laline, its affiliates, partners, licensors, dealers, suppliers and agents (and each of their respective employees, officers, directors, shareholders and representatives) (collectively, the “Laline Parties”) do not guarantee or warrant the performance, availability, coverage, uninterrupted use, security or operation of the Program or the Program Materials. Except with respect to residents of Quebec, the Laline Parties do not make any express or implied representations, warranties or conditions, including warranties of title or non-infringement, or implied warranties of merchantable quality or fitness for a particular purpose, with regard to the Program or the Program Materials. Except with respect to residents of Quebec, all representations, warranties and conditions of any kind, express or implied, are excluded to the maximum extent permitted by applicable law.
Except in Québec for damages resulting from a Laline Party’s own act or gross fault, the Laline Parties will not be liable to you or any third party for any direct, indirect, incidental, special, consequential or punitive damages or any loss that results from any aspect of the Program, the Program Materials or your participation in the Program, including but not limited to: (i) our termination, restriction or suspension of the Program; (ii) our changes to the Program, including but not limited to Catalogue changes; (iii) any authorized or unauthorized access to your Account; (iv) any loss of Laline Rewards for any reason whatsoever; (v) your selection and/or use of any Laline Rewards; (vi) any unavailability of the Program or Program Materials; (vii) any errors in the Program Materials or your personal information; and/or (viii) any tax consequences or any charge imposed by or with the authority of any government that you may face due to your participation in the Program. These limitations apply regardless of whether the party liable or allegedly liable was advised, had other reason to know, or in fact knew of the possibility of such damages or loss.
You agree to indemnify and hold harmless the Laline Parties from and against any claims, losses, damages, costs and expenses (including, without limitation, reasonable legal fees and other litigation expenses) incurred by the Laline Parties arising out of: (i) your failure to comply with these Terms and Conditions; (ii) any authorized or unauthorized access to your Account; and (iii) your use or misuse of any Laline Rewards. Laline and you agree and intend that the Laline Parties shall have the express benefit of the foregoing provisions regarding no warranties, limitation of liability and indemnification, and shall rely upon them and enforce them.
If any provision in these terms and conditions is determined to be illegal, invalid or unenforceable, that provision will be severed and the remaining provisions shall remain in full force and effect. Except as specifically outlined herein, these terms and conditions represent the only agreement between the Member and Laline in connection with the Program and supersedes all prior agreements, understandings, negotiations and discussions, whether oral or written. There are no representations, warranties, covenants, conditions or other agreements, express or implied, collateral, statutory or otherwise, including implied warranties or conditions of merchantability or fitness for a particular purpose, between a Member and Laline in connection with the Program, except as specifically set forth in these terms and conditions.

Except for Members residing in the province of Quebec where these Terms and Conditions shall be governed by the laws of Quebec and the jurisdiction of its courts, these Terms and Conditions shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein and such Members shall attorn to the jurisdiction of the Province of Ontario.
